1. Acceptance of Terms

By accessing and using AzuraMed's services, including our website, mobile application, and telemedicine platform, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Description of Service

AzuraMed provides online healthcare consultation services, including but not limited to video consultations, home visits, prescription services, and medical advice. Our services are provided by qualified healthcare professionals registered with the appropriate regulatory bodies.

  • Online video and audio consultations with licensed healthcare professionals
  • Home visit services for eligible patients
  • Prescription services where clinically appropriate
  • Medical advice and health information
  • Referral services to specialists when needed

3. User Account and Registration

Account Creation

To access certain features of our service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

Account Eligibility

You must be at least 18 years old to create an account. For users under 18, a parent or guardian must create and manage the account. You represent that you have the legal capacity to enter into these terms.

4. Medical Services and Limitations

Not a Replacement for Emergency Care

Our services are not intended for emergency medical situations. If you are experiencing a medical emergency, please call your local emergency services immediately. Our platform is designed for non-emergency consultations and routine healthcare needs.

Clinical Judgment

All medical advice, diagnoses, and treatment recommendations are based on the professional judgment of our healthcare providers. While we strive to provide accurate and helpful information, healthcare decisions should be made in consultation with qualified professionals.

Prescription Services

Prescriptions may be issued at the discretion of our healthcare providers when clinically appropriate. Controlled substances and certain medications may not be available through our platform. All prescriptions are subject to applicable laws and regulations.

5. Payment Terms

Service Fees

Our consultation services are subject to fees as displayed on our pricing page. Fees may vary based on the type of consultation, time of day, and other factors. All fees are displayed in advance of booking.

Payment Methods

  • We accept major credit and debit cards
  • Payment is required at the time of booking or before the consultation
  • All payments are processed securely through our payment partners
  • Refunds are subject to our cancellation policy

Subscription Services

If you subscribe to our subscription plans, you agree to pay the recurring fees as specified in your subscription agreement. Subscriptions may be cancelled at any time, with access continuing until the end of the current billing period.

6. Cancellation and Refund Policy

  • Consultations may be cancelled up to 24 hours before the scheduled time for a full refund
  • Cancellations within 24 hours may be subject to a cancellation fee
  • No-shows will be charged the full consultation fee
  • Refunds for technical issues will be assessed on a case-by-case basis
  • Subscription cancellations take effect at the end of the current billing period

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal and health information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

8. Intellectual Property

All content on the AzuraMed platform, including but not limited to text, graphics, logos, images, software, and the overall design, is the property of AzuraMed or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

9. User Conduct

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Provide false or misleading information
  • Impersonate another person or entity
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to any part of the platform
  • Use the service for any illegal or unauthorized purpose
  • Harass, abuse, or harm our staff or other users
  • Record consultations without explicit consent

10. Limitation of Liability

To the maximum extent permitted by law, AzuraMed and its healthcare providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

11. Indemnification

You agree to indemnify, defend, and hold harmless AzuraMed, its officers, directors, employees, agents, and healthcare providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any material changes by posting the updated terms on our website and updating the 'Last Updated' date. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

13. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without cause or notice, for any reason including, but not limited to, breach of these Terms, fraudulent activity, or any other conduct we determine to be harmful to our business or other users.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AzuraMed operates. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration or in the appropriate courts of that jurisdiction.
